These Terms and Conditions (“Terms”) govern the use of the website www.diamonddotpainting.co.za (“Website”) and the purchase of any products from Diamond Dot Painting® (“we”, “us”, “our”, “Company”).

By accessing the Website or placing an order, you agree to be legally bound by these Terms. If you do not agree, you may not use the Website or purchase our products.

3. ELIGIBILITY TO PURCHASE

By placing an order, you warrant that:

• You are 18 years or older
• You have the legal capacity to enter into a binding contract
• All information provided is accurate, complete, and truthful

4. PRODUCTS & DESCRIPTIONS

We take reasonable care to ensure that product descriptions, images, pricing, and specifications are accurate.

However:

• Product colours may vary slightly due to screen/display differences
• Images are for illustrative purposes only
• Handcrafted and DIY items may have natural variations

Diamond Dot Painting® reserves the right to amend product information without prior notice.

5. CUSTOM & PERSONALISED PRODUCTS

Custom or personalised diamond dot designs are created using images provided by you.

By submitting an image, you confirm that:

• You own the rights to the image or have permission to use it
• The image does not infringe copyright, privacy, or intellectual property rights

NOTE: Custom products are made to order and are non-refundable and non-returnable, except where defective or incorrect due to our error (as per CPA).

6. PRICING

• All prices are listed in South African Rand (ZAR)
• Prices include VAT where applicable
• Prices exclude shipping unless otherwise stated

We reserve the right to correct pricing errors. If an error affects your order, you will be contacted before processing.

7. PAYMENT METHODS

We accept payment via secure third-party payment gateways, including but not limited to:

• PayFast
• Ozow
• EFT

Diamond Dot Painting® does not store payment card details. All transactions are encrypted and processed by compliant payment service providers.

Orders will only be processed once payment is successfully received.

8. ORDER CONFIRMATION & ACCEPTANCE

An order confirmation email does not constitute acceptance.

Acceptance occurs only once payment has cleared and the order is processed.

We reserve the right to cancel any order for legitimate reasons, including stock availability, suspected fraud, or pricing errors.

9. SHIPPING & DELIVERY

9.1 Delivery Partners

We use third-party couriers, including but not limited to:

• The Courier Guy
• Globe Flight

9.2 Delivery Timeframes

Estimated delivery times are provided as a guide only and are not guaranteed.

Diamond Dot Painting® is not liable for courier delays outside of our control.

9.3 Risk & Ownership

Risk in the goods passes to you upon delivery to the specified address.

• You are responsible for ensuring that:
• Delivery details are correct
• Someone is available to receive the parcel

10. RETURNS, REFUNDS & EXCHANGES

10.1 Standard Products

In accordance with the CPA:

• You may return standard products within 7 days of delivery if unused, unopened, and in original packaging
• Return shipping costs are your responsibility unless the product is defective or incorrect

10.2 Defective or Incorrect Products

If a product is defective or incorrect:

• Notify us within 7 days of delivery
• Provide clear photos and order details
• We will repair, replace, or refund at our discretion as required by law

10.3 Custom Products

Custom or personalised products are not eligible for refunds or exchanges, unless defective.

11. INTELLECTUAL PROPERTY

All content on the Website, including but not limited to:

• Text
• Images
• Logos
• Designs
• Product names
• Branding

is the intellectual property of Diamond Dot Painting® and may not be copied, reproduced, or used without written permission.

12. USER CONDUCT

You agree not to:

• Use the Website for unlawful purposes
• Interfere with website security or functionality
• Upload malicious code or harmful content
• Misuse promotions, discounts, or referral systems

We reserve the right to suspend or terminate access for misuse or abuse.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

Diamond Dot Painting® shall not be liable for:

• Indirect or consequential damages
• Loss of profit, data, or business
• Delays caused by third-party couriers
• Use or misuse of products after delivery

Nothing in these Terms limits liability that cannot be excluded under South African law.

You indemnify and hold Diamond Dot Painting® harmless against any claims, damages, or losses arising from:

• Submission of unlawful or infringing content (including custom images)
